IIRC, Caravel is legally required to keep DROD open-source due to the legal agreement by which Webfoot gave them the rights to further develop DROD.

It's not essential to the game in any way, and if someone else were to make a version for the app store they'd have to enter into a contract with Apple first anyway - and then they could either add the code themselves or ask Caravel for it...
The code on it's own without a contract with Apple won't do any good anyway.
